Recommendations of the French Medical Association :

The conditions under which a physician may use a site are varied, and a distinction must be made between :

  • artisanal" use, i.e. either on an individual basis, or as part of a doctors' association, or as part of a hospital or clinic practice. In this case, the practitioner is personally responsible for the site, and therefore for the ethical conditions under which it is used.
  • industrial" use, i.e. within a healthcare site offering its services to the physician, who intervenes within the framework of a pre-established organization of the site promoter and must then do so according to a contract (recommendations concerning medical and internal practice, bulletin n°10 December 2000). The practitioner must then ensure that the promoter respects the ethical conditions of good practice in the contract. In conjunction with the Contracts Committee, the CITN has studied a draft defining the basic clauses of a standard contract between a doctor and a company operating an Internet site. This text was adopted by the Conseil National de l'Ordre des Médecins on February 2, 2001, and is available on the Conseil's website: www.conseil-national.medecin.fr.

 

The information conveyed by the physician on his site must respect the application of ethical rules in the following areas:

  • strictly medical information concerning his or her specialty and including scientific or practical indications. Articles 13 and 14 of the Code of Ethics must be respected, ensuring that this information is scientifically accurate, exhaustive, up-to-date, reliable, relevant, lawful, intelligible and validated (recommendations already available on the Cnom website).
  • This is where doctors present their own activities on their website. The website then plays the same role as the nameplate, prescriptions or information displayed in the doctor's waiting room, in providing information to the user-patient. This is the main purpose of these recommendations.

The doctor can present his site, his person, his practice and his practice. We specify the recommendations resulting from our analysis of the situation and the application of the code of ethics, in particular articles 79, 80 and 81 by assimilation.

Introducing the doctor

Identity

The following are authorized: surname, first name, date of birth, Ordre registration number, and a recent passport photo, in accordance with current standards required for the production of official identity papers. By authorizing the publication of a doctor's photograph for the general public, the CNOM has taken a step forward, since until now this was forbidden in order to avoid any advertising interpretation. The Web is an audiovisual medium that needed to evolve in this direction.
Professional title and qualification
The members of the Commission wish to limit the authorizations for publication on the Internet in accordance with article 79 of the Code of Medical Ethics concerning prescription forms. In accordance with articles 40, 50 and 79, the publication of titles and diplomas of non-medical higher education has not been accepted by the Cnom.
Medical information about publications
It seems possible, but any mention of the doctor's scientific publications also implies mention of any related conflicts of interest; this publication must also meet the (aforementioned) conditions of quality for medical information published on a website.

Firm presentation

Access

These may include: address, telephone, fax, e-mail (preceded by a warning if confidentiality is not required); a map of the area, means of transport to the practice, parking, disabled access, elevator; and, of course, the days and times of consultations and visits. The use of software to book appointments directly via the website must be done after an initial doctor-patient contact, in order to give the patient an access code or technique. This is to prevent doctors who have this service and advertise it on their site from using it as a promotional tool to attract Internet users with whom there has been no prior contact. The following information must be included: the means of responding to emergencies and permanent care (doctors on duty, local organization of this, referral to 15), in accordance with legal requirements. Leave dates, information on the presence of a replacement or referral to one or more colleagues are accepted.

Associates

These may appear on the practitioner's site, but without any automatic reference or direct link to the partner's site, as long as the sites are distinct (to avoid an automatic link via the Internet). If the site is created by a group, an association, a SCP, a SEL, etc., the link will be internal to the site and therefore authorized.

This information must be provided in accordance with the French Data Protection Act (CNIL January 1978).

Fees

Applied in strict compliance with the law: status with regard to the Convention, tariffs for the main procedures, membership of an AGA, etc... In accordance with the opinions previously issued by the Cnom on this subject, the conventionnelle médecin-référent option cannot be indicated at first glance, since it is applied in partnership with a patient who may or may not accept it.

Existence of a secondary practice, technical extension of activity

This may include an e-mail address, but not an automatic link, to avoid being too restrictive or prescriptive, and to respect the patient's freedom of choice as far as possible. Any mention of the number of procedures performed by the practitioner (particularly in public or private hospitals) is not acceptable. Aside from the promotional aspect, and in the absence of official standards, quantity is no indication of the quality or competence of the practitioner. In all circumstances, information relating to the professional's practice must remain clear and comprehensible (provision of data supplied by the professional), informative and non-promotional. Articles 19 and 20 of the CDM set out the precautions to be taken when using this information (no advertising, no assimilation of medicine to a business, the practitioner's responsibility for the use made of his or her name or image). Quality must remain the driving force behind the development of Internet communication in the medical field, through the only unavoidable means of respecting the ethics of the Internet patient: deontology.

Technical description and photographs

"The description of the nature of the procedures and techniques performed by the doctor may be given on information sheets which will precede, accompany or follow the information given by the doctor during the consultation. They may be illustrated with diagrams. But the publication of photos, even if anonymized, or of "before and after" iconography could lead to confusion between the obligation to provide information and the obligation to deliver results. Furthermore, the Conseil National considers that such publication could lead to advertising-type drifts for an uninformed public. Similarly, the presentation of individual situations under the guise of "clinical cases" is strictly prohibited.

Consequently, in order to respect the advice of prudence of the "Conseil de l'Ordre des Médecins", Doctor Sylvain DAVID specifies in preamble to the visualization of the photographs:

  • The photographs presented on this site are intended to provide additional illustrative lighting to the written information on this site, which we feel is essential due to the specific nature of plastic surgery, whose mission is to affect physical appearance. Indeed, reconstructive and aesthetic plastic surgery is a specialty that can also be appreciated through photographic visuals, as is the case in congresses and scientific literature.
  • On the other hand, the photographs presented on this site correspond to specific cases, with which a patient can in no way identify: each patient is different in terms of anatomy, healing capacity and therapeutic objectives. This preamble is intended to make this clear to visitors to the site.
  • These photographs are not intended to achieve a specific result, but to provide information on therapeutic possibilities. They are not intended for advertising purposes, but exclusively for information purposes.
  • Only a surgeon qualified in Plastic, Aesthetic and Reconstructive Surgery can explain to the patient, after examining him or her, the result that he or she can reasonably expect to obtain. The patient cannot therefore equate his or her case with that of the photographs displayed on this site, and therefore cannot confuse it with an obligation of result.
  • In accordance with the recommendations of the "Health On the Net" Foundation we add the following clarifications: the same person is visible in the images, the photographs have not been retouched or enhanced, the expected results are specific to each individual, the after-effects of a surgical operation cannot be guaranteed to 100%, the consent of the persons whose images are published on the site has been duly obtained.

 

INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

All regulations applicable to Internet sites must be complied with, and in particular :

  1. Law no. 78-17 of January 6, 1978 on data processing, data files and individual liberties, which requires information to be provided in the event of the collection and processing of personal data - particularly in the event of the provision of an appointment reminder service for the practice's patients. Sample information notices are available on the CNIL website.
  2. Law no. 2004-575 of June 21, 2004 on confidence in the digital economy, which requires clear identification of the site owner.
